This Distance Selling Contract (“Contract”) applies to all sales of 3D architectural rendering services (“Services”) offered by Studio B&Y (“Seller”) through its website at www.studiobycreatives.com (“Website”) to consumers (“Buyer”). By placing an order for Services through the Website, Buyer agrees to be bound by the terms of this Contract.

1. Order Process and Acceptance: Buyer may place an order for Services through the Website. Seller will acknowledge receipt of the order by sending an email to Buyer’s email address. However, this acknowledgement does not constitute acceptance of the order. Seller reserves the right to accept or reject any order in its sole discretion. The contract between Seller and Buyer will be formed only when Seller sends an email to Buyer confirming that Seller has accepted the order (“Acceptance Email”).

2. Services: Seller will provide the Services to Buyer in accordance with the terms set forth in the Acceptance Email. The Services will be provided using commercially reasonable efforts and in accordance with industry standards. Seller may use third-party contractors to provide the Services.

3. Payment: Buyer shall pay the fees for the Services as set forth in the Acceptance Email. Payment shall be made by credit card or such other payment method as may be specified on the Website. Seller shall not be responsible for any fees or charges imposed by Buyer’s bank or credit card issuer.

4. Delivery: Seller will deliver the Services to Buyer via electronic means as specified in the Acceptance Email. Buyer is responsible for ensuring that its computer systems are capable of receiving and utilizing the Services. Seller shall not be responsible for any loss or damage to the Services once they have been delivered to Buyer.

5. Cancellation and Refunds: Buyer may cancel an order for Services at any time before the Acceptance Email have been sent to Buyer. If Buyer cancels an order, Seller shall refund any fees paid by Buyer for the Services.

6. Warranties and Disclaimer: Seller represents and warrants that the Services will be provided in a professional manner in accordance with industry standards. Seller makes no other representations or warranties, express or implied, regarding the Services. Seller specifically disclaims any implied warranties of merchantability or fitness for a particular purpose.

7. Limitation of Liability: Seller shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the Services or this Contract, whether or not Seller was advised of the possibility of such damages. Seller’s total liability under this Contract shall be limited to the amount paid by Buyer for the Services.

8. Entire Agreement: This Contract constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior agreements and understandings, whether written or oral, relating to such subject matter.
